This Privacy Policy ("Policy") applies to Nexly LLC ("Nexly," "we," "us," or "our") and governs the collection, use, and disclosure of personal information in connection with our social media application, website, and related services (collectively, the "Services"). By using the Services, you agree to the data practices described in this Policy. Where required by law (e.g., GDPR/UK GDPR, CPRA), we rely on legal bases such as consent, contract, and our legitimate interests.
Age Restrictions and U.S. Users
Nexly is intended for use only by individuals who meet the minimum age requirements described below.
- United States: You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian and only if you and your parent or guardian review this Policy and our Terms of Service together.
- If we learn that we have collected personal information from a child who is under 13 in the U.S. without verifiable parental consent, we will take reasonable steps to delete that information and, where appropriate, terminate the associated account.
- By creating an account or otherwise using the Services, you represent that you meet the minimum age requirement in your jurisdiction and, if you are between 13 and 17 in the U.S., that you have your parent or legal guardian's permission to use the Services.
Information We Collect
- Account Data: Username, display name, email address, password (hashed), and profile details you choose to add (e.g., bio, avatar).
- User Content: Posts, comments, messages, media (photos/videos), and related metadata you upload or generate.
- Device & Usage Data: App version, device identifiers, OS, language, crash logs, and analytics on how you use the Services.
- Payment & Transaction Data: We do not store full payment card numbers. Purchases are processed by third-party payment providers and/or app stores. We may receive limited details such as a transaction ID, payment status, and receipt metadata.
- Optional Data (with permission): Camera, photo library, microphone, contacts, and location data (see "Mobile Device Permissions" below).
How We Use Personal Information
We use the personal information we collect for the following purposes (and rely on legal bases such as consent, contract performance, compliance with law, and our legitimate interests, as applicable):
To provide and operate the Services:
- Create and manage your account and profile.
- Enable you to create, share, and view content and interact with other users.
- Maintain and operate core features such as feeds, messaging, search, and notifications.
To personalize your experience:
- Recommend content, accounts, and features based on your activity, interests, and preferences.
- Customize in-app experiences, including feeds and discovery surfaces.
- Show you content and features that are more relevant to your region, language, age, and device.

- Respond to your inquiries, feedback, and support requests.
- With your consent where required, send marketing or promotional communications about Nexly and our partners, which you can opt out of at any time.
To provide support and improve quality:
- Diagnose and fix technical issues, monitor performance, and improve the stability and security of the Services.
- Analyze how users engage with features, content, and interfaces to improve design and usability.
- Conduct troubleshooting, testing, and research to improve existing features and develop new ones.
To process purchases and manage transactions:
- Facilitate payments, subscriptions, and in-app purchases through our payment processors and app stores.
- Verify transactions, provide receipts, and address billing or payment-related inquiries.
- Prevent, detect, and address fraud or unauthorized transactions.
To promote safety, integrity, and security:
- Monitor, detect, investigate, and prevent abuse, harassment, spam, fraud, security incidents, and other harmful or illegal activities.
- Enforce our Terms of Service, community guidelines, and other policies.
- Protect the rights, property, and safety of users, Nexly, and others.
For analytics, research, and development:
- Aggregate and de-identify information to analyze trends, usage patterns, and user behavior.
- Measure the effectiveness of product features, campaigns, and user experiences.
- Develop, train, and improve algorithms, models, and systems that power recommendations, search, and other features (where required, using anonymized or pseudonymized data).
For advertising and marketing (where applicable and permitted by law):
- Measure and understand the performance of promotional content or campaigns.
- Show you Nexly-related content, promotions, or offers that may be relevant to you.
- Where required by law, we will obtain your consent before using cookies or similar technologies for targeted advertising, and you can withdraw your consent or adjust your preferences at any time.
To comply with legal obligations and respond to lawful requests:
- Comply with applicable laws, regulations, legal processes, and enforceable government requests.
- Respond to subpoenas, court orders, or other lawful requests for information.
- Maintain records necessary to meet regulatory, tax, and accounting requirements.
For other purposes with your consent:
- When you agree to a specific new purpose, we will use your information only for that purpose and as described at the time of consent.
- You may withdraw your consent at any time in accordance with applicable law, but this will not affect processing that has already occurred.
Mobile Device Permissions
With your consent, the app may request access to certain device features. You can enable/disable these anytime in your device settings (permissions may be required for specific features to function).
Camera
To capture photos/videos for posts, stories, or your profile. Images/video are uploaded only when you choose to do so. We do not access the camera when the feature is not in use.
Photos/Media Library
To select existing media for upload or to save content locally (if you choose).
Microphone
To record audio for videos/voice features (if you choose).
Location (Approximate/Precise)
To tag content with a location, show location-based features, or improve recommendations—only if you grant permission.
Contacts
To help you find friends (e.g., by matching hashed contact identifiers). We do not import contacts without your consent, and you can disable this at any time.
Notifications
To send push notifications about activity (e.g., likes, follows, messages). You can manage these in your device settings.
Payments & In-App Purchases
Payments may be processed by app stores (e.g., Apple App Store/Google Play) or third-party processors. Nexly does not store full payment card details. We receive limited transaction information for fraud prevention, fulfillment, and support. Please review the processor's privacy policy for details on their data practices.
Sharing Information with Third Parties
We do not sell, rent, or lease your personal information. We may share data with trusted service providers that assist with hosting, analytics, customer support, messaging, content moderation, and payments. These providers are bound by confidentiality and security obligations and may only use data as instructed by Nexly.
We may disclose information if required by law, to protect rights, safety, and security, or in connection with a corporate transaction (e.g., merger, acquisition). We may transfer data to countries other than your own; where we do, we use appropriate safeguards permitted by applicable law.
User Content Visibility
Content you post may be visible to other users or the public depending on your settings and app features. Please do not share sensitive personal information in public content. You can delete your content in the app where available or contact us for assistance.
Cookies, SDKs & Analytics
We and our providers use cookies, mobile SDKs, and similar technologies to operate the Services, remember preferences, measure performance, and improve features. You can control certain cookies via your browser and manage app tracking/advertising preferences in your device settings where supported.
Data Retention
We retain personal information for as long as your account is active or as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type and purpose. We delete or anonymize data when it is no longer needed for the purposes described in this Policy.
Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is 100% secure, and we cannot guarantee absolute security. Transmissions over networks may occur unencrypted and involve adaptations to meet technical requirements.
Your Rights (GDPR/UK GDPR, where applicable)
If you are located in the EEA, Switzerland, or the UK, you may have the right to request access, correction, deletion, restriction, portability, and to object to certain processing, as well as the right to withdraw consent. You may also lodge a complaint with your local supervisory authority. Nexly LLC is the data controller for Services provided directly by Nexly.
US State Privacy Rights (e.g., California)
Depending on your state of residence, you may have rights to request access, correction, deletion, portability, and to opt out of certain targeted advertising or sharing. Nexly does not "sell" personal information as defined by applicable law. If our practices change, we will update this Policy and provide required opt-outs. You will not be discriminated against for exercising your rights.
Right to Deletion
Subject to certain exceptions, upon receiving a verifiable request, we will delete your personal information and direct our service providers to do the same. We may retain information as permitted by law (e.g., to complete a transaction, detect security incidents, debug, comply with legal obligations, or for internal uses aligned with your expectations).
Children's Privacy
We do not knowingly collect personal information from children under the age of 13 in the United States (or under the age of digital consent in other jurisdictions where applicable). If you believe a child has provided us personal information without parental consent, please contact us and we will take appropriate steps to delete such information and, where appropriate, close the child's account. If we become aware that an account is being used by a child under 13 in the U.S. without the involvement of a parent or guardian, we may suspend or terminate the account.
Email & Push Communications
We may send emails or push notifications about account activity, security alerts, and updates. You can opt out of marketing emails via the unsubscribe link and manage push notifications in device settings. We may track open/click rates to improve deliverability and relevance.
Links & Third-Party Services
The Services may link to third-party websites or integrate third-party services. Their privacy practices are governed by their own policies. Please review those policies before sharing information with them.
Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices or legal requirements. If changes are material, we will provide notice (e.g., in-app, email) and indicate the effective date. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
